1. Acceptance of These Terms

Welcome to EZ Owner Finance, operated by JK III Management LLC ("we," "us," or "our"). By accessing or using ezownerfinance.com (the "Site"), submitting an application or inquiry, or using our tenant portal, you agree to these Terms of Service. If you do not agree, please do not use the Site.

2. What We Do — and What This Site Is Not

We offer rent-to-own, owner-financed, and rental housing opportunities. Information on this Site — including property listings, payment estimates, and the payment calculator — is provided for general information only and does not constitute an offer of credit, a loan commitment, legal advice, tax advice, or financial advice.

No agreement exists between you and us until both parties have signed a written contract for a specific property. Qualification criteria, pricing, down payments, and terms vary by property and are subject to change without notice.

3. Applications and Eligibility

When you submit an application or inquiry, you certify that the information you provide is accurate and complete. We may verify the information you provide, including income and identity. Submitting an application does not guarantee approval or reserve a property. Properties are offered on a first-qualified, first-served basis and may be withdrawn at any time.

4. Calls, Texts, and Email (TCPA Consent)

If you provide your phone number and check the consent box on our forms, you consent to receive calls and text messages from us (including automated messages) about your inquiry, application, properties, and related services. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to any text to opt out, or contact us using the information below.

5. Tenant Portal

The tenant portal is provided for residents to view payment information, submit maintenance requests, access documents, and use related services. You are responsible for keeping your login access secure and for the accuracy of information you submit. Portal information (including balances) is provided for convenience; your signed lease or purchase agreement controls in case of any conflict.

6. Third-Party Offers and Affiliate Links

The Site and tenant portal may feature offers from third-party partners (for example, renters insurance providers). Some of these are affiliate links, meaning we may earn a commission if you sign up — at no additional cost to you. We feature partners we believe are genuinely useful, but we do not operate, control, or guarantee third-party products or services. Your relationship with any partner is governed by that partner’s own terms and privacy policy.

7. Intellectual Property

The Site and its content (text, graphics, logos, and software) are owned by JK III Management LLC or its licensors and are protected by law. You may use the Site for personal, non-commercial purposes. You may not copy, scrape, republish, or create derivative works from the Site without our written permission.

8. Acceptable Use

You agree not to: misrepresent your identity or information; use the Site for any unlawful purpose; interfere with the Site’s operation or security; attempt to access accounts or data that are not yours; or use automated tools to extract data from the Site.

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that listings, estimates, or other content are error-free, complete, or current.

10. Limitation of Liability

To the fullest extent permitted by law, JK III Management LLC and its members, managers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred dollars ($100). Nothing in these Terms limits liability that cannot be limited under applicable law, and nothing in these Terms limits your rights under a signed lease or purchase agreement.

11. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Site.

12. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Site will be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction. This section applies to use of the Site; signed leases and purchase agreements contain their own governing-law provisions.

13. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date below reflects the latest version. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
